Definitions Artist: The individual producing the Commission (“Ellie”)
 Client:The individual purchasing the Commission Commission: The service being provided by the Artist to the Client. “Commission”, “Art”, “Image”, “Project” are used interchangeably within the Commission Agreement and within the Commission correspondence.
 Commission Agreement: The discussion documented via email, mc-market.com or within the discord server. Within this discussion the Artist and Client agree to the subject matter and type of Commission to be produced along with the price and Commission completion time frame. 
 Commercial Purpose: Any Commission that does not fall under the type of use specified in these Terms of Service. New Terms of Service shall be agreed upon in a Commercial Purpose Commission Agreement prior to the start of work. 
 Commercial Purpose Commission Agreement: A Commission Agreement developed specifically for Commercial Purpose Commissions which is developed on a case-by-case basis.(edited)

Terms
 1. The Artist has the right to refuse any Commission request prior to payment. 
2. The Artist reserves the right to stop work on or cancel a Commission. 3. By commissioning the Artist, the Client is purchasing the time and labour spent only. The Artist retains rights to the artwork produced which includes but is not limited to the use of the Commission within online pages, personal or public space to promote the Artist unless otherwise agreed upon within a non-disclosure agreement. 
4. The Artist does not have the right to use the artwork or project for direct commercial purposes unless agreed upon with the Client. 5. The Client must specify the content of their Commission to the best of their ability within the Commission Agreement prior to any sketches, mockup or payment. After a description and quote is agreed upon, changes to the design that would incur additional time spent on a mock-up, sketch or final artwork will result in additional fees based on an hourly rate. 
 6. If the Commission is time-sensitive or requires completion before the displayed predicted completion time for commissions then a rush fee may be applied.

7. The Client may not edit, alter or trace the Commissioned work without the Artist’s permission or agreed upon in the Commission Agreement prior to payment. The Client may not give the Artwork to someone else to edit, alter or trace the Commissioned work either. 
8. If the Commission is confidential then the client must express when public display by the Artist would be permitted.
 9. The Artist reserved all rights to call the artwork their own. 10. If the Commission is for Commercial Purpose, the Artist must be notified prior to the start of work and prior to payment, Commercial use of the Commission will be decided on a case-by-case basis in which the Client and Artist will agree upon within the Commercial Purpose Commission Agreement. 11. The Client may request a preview or update on the Commission at any time during the process however if the Client requests changes the Artist may charge for additional fees if payment has already been sent or if requesting large or multiple changes to the mockup. 12. The Artist will provide PNG files once the Commission has been completed. If the Client would like the source file (PSD,PRO) then an additional charge will be applied.

Payment and Refunds Payment: The Artist requires payment upfront. The Artist may supply sketches or a rough mockup prior to payment but is not obliged to. Method: The Artists preferred method of payment is via PayPal invoicing. Once ready to proceed with the Commission the Artist will send an invoice to the Clients PayPal email once provided. 
 Cancellation: The Artist reserves the right to stop work on or cancel a Commission. 
Refunds: 
If the Artist cancels a Commission, they must provide the Client a full refund provided payment has been received. Refunds may only be issued to the Client if the Client notifies the Artist prior to the start of work. No refunds will be issued after the start of work unless the Artist cancels the Commission.
