Hello i think its fair to say the current EULA is not being enforced and lacks specific details pertaining to what exactly a user can buy.

Im posting this because the EULA needs to be more specific so we can follow it better. Im just wondering if anyone has connections with any Mojang employees or has any information on us getting a better explained EULA.

Honestly, the EULA kills most servers and should be modified. Nobody is going to buy a namecolor on a KitPvP server. The fact that it's not enforced helps a lot of servers, and I really believe that Mojang doesn't care much and that this was a move by them to make the Microsoft acquisition go smoother. Marc_IRL

Well im making an alternative to mineplex and would hate to make a bunch of perks for a rank only to have to remove them because it doesnt comply with a eula. Which is why we need an updated eula that goes into details.

Watch though we dont follow the eula and they start enforcing it... What about the devlopers like myself who make custom perks for ranks...

This is month old drama, they tried and failed enforcing it back in August, theres no point bringing the topic back up.

I'm pretty sure the whole point of the EULA was to scare the people who were creating huge donation costs. If they don't strictly enforce it, they are just looking to have a backup in the case that people are going crazy with donations and they want to prohibit that.

I dont want to waSTE time for rank perks to have to remove them if they ever do enforce 8(
If you are not including a crazy pay-to-win system with donations, then they wouldn't bother you. Even if you did, unless you were earning millions, they wouldn't care.

I mostly second what Crisis said.
What's more, the current EULA is full of loopholes, as Hypixel and Mineplex as well as Arkham are demonstrating. The problem is that for smaller servers, to make changes for those loopholes is a lot more costly per potential donation than they are for the giant networks. The new donation systems also mean less people that donate per playerbase.
I'll list a few loopholes that appear to exist.

first, Paying to have access even if a server is full. Most donator ranks on hypixel seem to have this, where you can join (and kick off non-paying users)
second, accelerating. This is where a paying user gets faster and easier access to certain resources than a non-paying user. Example: In Hypixel's "Housing" gamemode, you can unlock certain blocks and background maps using hypixel credits. A non-paying user only gets a few of these per day, while they can be bought with money from the store in much larger qualities, and donator ranks get a much larger daily amount.

Third, and this isn't really a loophole, paid servers. Servers made only for paying users that are only accessible to paying users. Basically you pay to play on the server. It was stated quite explicitly during the time of the EULA change that this is allowed.

There's plenty more loopholes and creative ways around it, such as the lootcrate system where non-paying members mostly get access to the lowest tier with the lowest chances of good loot, but have a tiny chance to get access to a higher tier, and can trade with paying users for access. Paying users get a much higher chance to get access to higher-tier crates.

All in all, servers have been forced to think creatively, and straight up pay2win is no longer a thing, but it is still a strong element, as that's one of the major things that attracts players towards buying ranks.
