I'm using googles inbuilt dark mode beta feature as I'm testing it for them, so if mc-market wants to go and argue with google about this they can.

Sorry, they won't 'argue' with Google nor can Google say websites cannot punish you for using it lol.
You still have to comply with the rules of each website you view, or accept the consequence(s) that come with not complying.
