Apparently you can't look to buy equity in servers in the established servers section but you can sell servers you have partial ownership of so it makes no sense.

Allow the sale of partial ownership of someone's server in established servers.

You could make the argument that buying anything is an investment with that logic.
Mainly building off of Bugless & Miso's replies & Diz's Suggestion. I think the suggestion should be turned into

"What does MC-Market count as an investment" or "What does MC-Market count as an Exclusive Product"
It'd feel much more helpful to have this question answered. I was there yesterday during Diz's rant and I
could feel and understand his frustration, no-where does it say "The server you sell has to be 100% & you
cannot sell partial percentages". I think the rules overall should be much clearer on either saying yes or no
to this or to outline a small simple wiki page explaining what makes a setup non-exclusive.

Right, so by no means am I speaking for Mick or for MCMarket - this is all just my personal opinion based on the suggestion.

Buying equity in servers is one of the most common types of investments and most MCM users should know this by now. Simply planning on selling your equity would be a way to bypass the list of forbidden products and services (which may be viewed here) and therefore completely goes against the original closing of the section.

Now moving on, I've never actually looked through your posts on "Investments & Loans" but I'd assume you would have looked at the section at one point or another. During the timeframe you've seen the section, I would infer that you most definitely have seen server owners offering equity of a server for an investment or in other terms - selling a part of their server for money.

As was stated to you by someone else with that logic buying anything is an investment. To be 100% transparent though I agree that my post would have been better suited in the investment section. I do however believe posting it in established servers breaks no rules and it has a lot of relevance to this site and established servers specifically. Buying a server is often seen as an investment, I haven't met anyone here that's opened a server without looking to make their money back. That's all I want, to buy % equity in a server in exchange for advertising funds, with a promise of my money returned before anyone else takes a profit.

A person with part ownership can sell aslong as they have permission from all shareholders. I see no similarities. Selling and Investing are two different categories. Unless they say they are selling there stake then I would agree that's a grey area. 50/50 with this honestly.

The issue here is with the category "Established Servers" the rules there are as follows. "Buy or sell established servers that have a playerbase. Non-exclusive servers and setups are not allowed in this forum." More specifically. "Non-exclusive servers and setups are not allowed in this forum." I was told by Harry that buying a percentage of a server breaks the rules for this section. So if that is the case my question is how did Mick sell the servers we were partners on 51/49 for in that section? Wouldn't we be breaking the rules as the server wasn't exclusive? I believe in this instance staff was manipulating the rules to favor their opinion because they didn't want me to bypass in a 100% fair way their removal of the investment system.

Only thing I will point out. You and Mick where 51/49 yes he didnt have 100% but as rule dictates 51% is an overulling position and has full control, to sell etc. The only thing is your 49% would have to be paid out of the agreed selling price he sold it for. That I don't see any problem with.

There is also massive risk of scamming and exploitation via someone requesting or looking for part ownership or percentage. No matter how good and strong your legal abilities are so on and so forth.

Alternatively have a section for possible buy-in/out with strict rulings. This could help alleviate your worrys and issues with the system of now. Either way only way to get buy this is make it mandatory to sign a contract.

That's really all I have to say and again I am 50/50 I don't see to many problems or good things. If the community wants it or agrees on it sure let it happen. See how it goes and play on from there.

My issue isn't with Mick selling the server, it's with the fact that based on the rules it shouldn't have been allowed. We both would have had ownership of the server thus making it nonexclusive based on how I was explained the interpretation of the rules by harry.

My issue is you can't say that a server being sold that has multiple owners is considered exclusive, but then say buying into a server makes the server nonexclusive.

I get your point, but following this line of argumentation buying an entire server would also be an investment. Even buying resource ownerships, builds with resell rights, etc. - all of these could be deemed potential investments, I don't really see the difference between buying a full server and buying a part of the server if there's an excessive amount of funds needed.

As Diz stated, selling a server while being a partial owner works, however buying a server as a partial owner doesn't - makes no sense.

I was told by Geek and Matty that this should be allowed (guess its up to the staff member). Honestly the stupidest thing mcm ever implemented and should be changed. Should honestly apply for websites and so on as well.

Hmm? When have I said this? My personal opinion doesn't account for "what should be allowed". I believe it solely depends on the terms of the transaction.

I recall asking you in the shout box and you said that it is allowed. Might of been a misinterpretation but thats what I believe was said.

To my knowledge, the only time I've spoken about this was with Diz in Shoutbox which prompted this suggestion.

I've also only ever spoken to Diz about the topic in SB and he understands I was speaking on my personal opinion and not on behalf of MCM or Mick as much. However, at no point or another did I say directly that it was "allowed" or that "it should be allowed".

As explained within shoutbox, you sold your ownership along with Mick's together, right? The receiver of the transaction received exclusivity over the server and all its assets, thus it's an exclusive sale and is fine to be posted in Established Servers.

Had Mick sold just his ownership percentage and you retained yours (which is what you're implying by not mentioning your ownership percentage was also included in the sale), he wouldn't have been allowed to post it in Established Severs due to the current description disallowing the sale of "non-exclusive" servers.

From our merchant agreement:
If a product is not fully exclusive, then it is non-exclusive.
Products sold exclusively are unique in that they are sold along with all rights to the product. Once the transaction for exclusivity is complete, the receiver is the only one with any usage rights, redistribution rights, or ownership rights (rights to give, revoke, or transfer rights to others).

Mick sold the server to two owners would this be agaisnt the rules as well? Since the buyers both only bought 50%?
