lets be honest though, who REALLY reads the terms of service anymore
If you're planning to sue a website, it's very very very smart to read the terms of service as most websites cover themselves pretty well against pretty much anything.

May I ask in your TOS do you clearly state you can ban them for any reason? If so then there is no way he will win the case in court anyway, not that he would anyways lol.[DOUBLEPOST=1471620924][/DOUBLEPOST]
You are dumb as hell. He has no case at all. Hes allowed to ban anyone with no reason at all.
That's debatable its what he says in his TOS. I agree that he's dumb as hell though and he has no case.

With all of this drama, I'd like to get an answer to one thing..

I'd like to know the boundaries between "This is my place, get out" & "Wait, this is against the law".

The boundary lies in terms of service. I doubt many people read them upon making an account, but I strongly recommend doing so now anyway. At least that way you know what your legal position is.
Regardless, you don't need to worry we'll ban people for actual bullshit reasons. If we started doing that, this website would be dead a few months later. As far as I know, 90% of people banned end up banned because they break the rules or scam. very few of them get banned because they dont break a rule, but do break the ToS.

In fact, Avster is the first one I can remember doing so.
Thanks so much for explaining.

I know this is out of topic, but if someone where to chargeback against a T.O.S you stated on a donation link, could I get them into trouble ? If so, how would be the best way?

Unfortunately, McM is not in a position to enforce ToS. If someone donated via a thread on this website, and charged back later, you could try opening a scam report, though I am not 100% on the results of that.

If it happened off site, we cannot do much. Terms of service are not the law. Avster got banned because what he was doing was something that would be considered a crime in many countries, and was therefore clearly illegal and thus against our ToS. It did not help that he gathered the info through this site.
If you 'merely' break the ToS of a company or service off-site, but your actions are not illegal in themselves, we cannot take action.

It is quite easy, considering your company name is public if you choose to accept payments. And Belgium is where they are. :)
If retard boy is over in the US he cant file a lawsuit against someone in Belgium correct me if I'm wrong but they are two different countries with two different governments and laws?

It depends on the circumstances. In general it makes it more difficult, but if it was a valid concern, it might be possible, if costly.
However, since it not valid...
well, you get the idea.
