Considering his account says 16 I dont think so. Even then they still can as they have the name Badlion under trademark.

Honestly I'd buy it just so I can name squat and sell it back to them. As long as the domain isn't being used to generate any income then it isn't in trade use and doesn't break any trademark's therefore you can sit on this till they pay to get it back from you.
