Can I be sued for this?

Hi,

I was wondering if I could be sued for this, I'll give you guys a scenario here: (this is not a true scenario, just an example)

I created a website called weinerparties.com. We host events for people, but are not trademarked, or registered as a company.

A real company called 'Weiner Parties' is registered by someone else. Can they sue me, and eventually take 'weinerparties.com' from me? Or would I get some sort of warning, then have to change all of my information, or could I keep the website & keep on hosting events?

They can take the domain, yes. If the content/subject is similar they can also take any profit you have made from their name.
EDIT: This assumes that the companies name is trademarked.

In reference to the name and general business, they can only pursue legal actions if you are both in the same country and/or state, subject to the local laws. Do research based on where you live.

As far as the domain, if they own the trademark or copyright, and can prove it, they can get legally take the name with a court order. They will more than likely reach out to you through a lawyer first and try to resolve the issue amicably. How you respond will dictate how the situation plays out from there.[DOUBLEPOST=1437349927,1437349606][/DOUBLEPOST]They can only take profits if they can prove you knowingly used the trademark or copyrighted item to gain those profits through deception. That's a general rule and can be different depending on the jurisdiction.
