Hello!

Recently, a user was banned and his account was deleted because he was in violation of the COPPA. Some of you may or may not know what this is so if you would like to understand it more click this link and keep reading this thread.

Long story short, COPPA stands for the abbreviation of the law named "Children's Online Privacy Protection Act". The law is about protecting underage children (12 and younger) and their families by not allowing a legal company to put the child's information into the websites database preventing any information that the family does not want being leaked or put somewhere online.

While some users that are 12 and younger may be very intelligent it doesn't necessarily mean they know how to make sure things don't get leaked etc. Which is one of the reasons why the COPPA was made.

There are ways to allow a 12 yr old or younger still be able to register on various sites that put their information onto the websites database by getting the adults signature on a legal document that gives the company permission. (You know those TOS's that you always end up skipping and saying "I agree" parts of that give permission to the company to store information into their database. So if your underage please ask an adult for permission!)

Now on the side of MC-Market Ajdin is the one who dealt with the user. However I have a few questions to ask him and I would appreciate it if he could answer them. (I will copy and paste his answers into the original thread.)

1). If you get caught breaking the COPPA on Mc-Market what are the consequences?

2). Will the user be able to return once they are old enough?

3). Can they user who gets banned get his account upgrades back or refunded?

4). What if the child who is breaking the COPPA lives in a state that doesn't enforce the act?

5). Can you make this or a different thread an official thread describing this act with the questions and answers?

The information provided is strictly factual. I have my own opinions on this.

Also, that wiki page specifically states that the laws only apply if you're in the jurisdiction of the United States.

I feel this sort of butchers the meaning of COPPA. With COPPA, a website is not allowed to KNOWINGLY collect information from children under the age of 13 without parental consent. If a person or company owning a website that collects information becomes aware that they've collected information from someone under the age of 13, then that person or company has to destroy such information and cease collecting information from that child unless parent consent is given (generally, in writing).

Now I don't know all the answer to your questions, but the one I can answer for sure is that if we become aware that you are under the age of 13, your account will be terminated and you will no longer be allowed to use MCM until you are at least 13 years of age. By law, we have to delete your account information, so I'm not sure it will be possible for you to regain access to your account when you turn 13, but you would be allowed back on the website once you reach that age. This does NOT mean you don't need your parent's permission to be on this website. You need your parent's permission if you are under the age of majority in your country (generally 18).

As for your account upgrades, our TOS state that purchases are non-refundable, so you shouldn't expect to be refunded if you purchase your upgrades while under the age of 13. However, BeBosny may exercise discretion in that particular case, I suppose.

COPPA is a law that website owners must follow, not users of those websites. The website owner is the one violating the law if they become aware of someone under the age of 13 and they continue to collect information from that person. COPPA is a federal law in the US, so it applies to all 50 states. Other countries have chosen to adopt laws after COPPA as well.

I'd be happy to make a thread, but in reality, I don't see a need to. The law has not changed. We are simply making sure that we are following it. If you want to learn more about COPPA, there's a thing called Google and you're welcome to research it yourself.


Honestly, COPPA is really really dumb, You made a risk to be on the internet, We all make choices, I understand its to not let Families info to get leaked but come on now. Why let your son/daughter be on a market in the first place? Thats there risk, We all make choices in life. That was something they choosen. 2nd lots of people can lie about there age on here, Honestly im 17 and before i placed 23 because i thought i needed to be 18 and + to join, Many members are intelligent now and will just switch there age and do the same thing i did. I seen lots of Members profiles that says 23,54,29,45 Of course those members are lying about there age. So really there are alot of little kids evading the site right now as we speak, But how will staff know that? They can't unless they admit it. And i know alot of Members wont admit it. Cake did but i honestly dont know why... i don't know if he knew he was getting banned or something. But COPPA is dumb and it always will be. This has been implemented in the 2000 and staff is just adding it now? Nothing has happened before then. Even if the law did contact MCM i am very sure they will warn them. The staff could have simply lied saying "i had no idea there was a COPPA TOS we will enforce right now" Just to save there butts if the site ever had to get suspended or some what. This honestly is the worst TOS im ashamed this is added. Just a quick note. I am not blaming staff for this. I am blaming the law. But i do think it was silly to add this as my examples made alittle sense.
That risk is not yours to take. Until you reach the age of majority (which is generally 18), your parents decide which risks they are willing to take on your behalf. You don't get to decide that. You're talking like you are choosing to take this risk, when in reality, the law's aim is to protect kids, not harm them. COPPA is not dumb. You're welcome to have your opinion, but know that the law wouldn't exist if everyone thought it was dumb, so clearly, it's not that dumb. Nothing has actually changed in terms of the TOS. We've simply clarified in our TOS that you must be 13 in order to use this website.


Well, a parent can allow you to use the site under 13, and the permission can be expressed via a checkbox.
I don't get why we all of a sudden enforce COPPA.
A simple checkbox wouldn't be good enough. We would have to ensure that it's the parent checking the box and not the child pretending to be the parent. It's not as simple as you think. Regardless, we don't allow children under the age of 13 to use this website, so even if you had a parent's permission, you still must be at least 13 years old. Also, we aren't enforcing COPPA. We are abiding by it. Big difference.

Most countries have adopted laws and policies that are similar to that of COPPA, including countries in the EU. In addition, MCM's servers are located in the United States, so US law does apply, as the data is stored in the US and subject to US jurisdiction.

I understand but this law was implemented in the 2000. There are so many websites not following this and nothing is happening to them. There are a lot of TOS out there. I'm very sure the law won't even notice about COPPA being added onto here.
It was revised in 2012 though. So they're actively working with it seemingly.

I know a god damn 12 year old who literally would DDOS or DOX anyone who would do him bad or even dislike his youtube video.

This kid is friends with a hacker so obviously he thinks he has all the power. My friend used to work on his server until basically the 12 year old DDOSed my friend when he wanted to quit. Then my friend proceeds to disliking a few of the kids YouTube videos as a joke and the kid assumed it was him and DDOSed him. I don't think anyone anymore under the age of 13 should use the internet without parental supervision and consent.

I didn't cause THIS COPPA to start effect on mcm. I wrote this up after I heard Bebosny starting to ban people under the Agedo 13[DOUBLEPOST=1467311150][/DOUBLEPOST]
