Denounce and prohibit homophobia, transphobia and general discrimination [1.6 Rule & Point Changes]

G'day g'day,

As a member of the LGBT+ community, I feel that this is an issue that needs to be addressed.


THE PROBLEM

Over the past few months, it has become apparent that this site has been very heavily derogatory toward certain community members and its users who say such things are not punished accordingly nor are they impacted in any notable capacity.


THE 'REASONING'

Some users have gone as far as to get into the etymology of the word 'transphobia' stating that they aren't 'scared' of transgender people. This. Is. Not. The. Meaning. Of. Transphobia.
Some users also think that their biblical or personal based opinion is a fact when it is very clearly not.
Other users plead that their discriminatory words and actions align with their country's 'freedom of speech' law. I have said this many times, and I will say it again; having the ability to say whatever you want to say doesn't mean that people won't be offended by it.
But, I don't know why I'm going on about freedom of speech, as it doesn't actually apply on this site.
This site is run under Australian law as Mick Capital Pty. Ltd. is a registered Australian business that this site runs under (as seen in the site's copyright footer).
This means that, in Australia, we have laws protecting the LGBT+ community and any other marginalised cohorts - in simple terms, transphobes and homophobes get fined for their discriminatory words and actions.
From 1st August 2013, discrimination against lesbian, gay, bisexual, transgender, and intersex people became illegal for the first time under national law. Many people have since received fines up to $5000 AUD, depending on publicity.
For any Australians, namely the one that runs this site, this would be found under the Sex Discrimination Act 1984 and was passed under the Sex Discrimination Amendment (Sexual Orientation, Gender Identity and Intersex Status) Act 2013.

MY SUGGESTION

In line with Australian laws and common human decency and respect, denounce and prohibit the use of homophobic and transphobic comments, remarks and actions as well as other discriminatory slurs.
This can be achieved by;

• Changing the current 1.6 rule as it is far too broad and needs clarification regarding what is considered 'disrespectful'.
• Editing the warning points for 1.6 violations depending on the severity;
  • Light Offence (basic disrespect) - 5 Warning Points
  • Moderate Offence (homophobia, transphobia, racism, etc.) - 10 Warning Points
  • Major Offence (harassment, excessive moderate offence violations) - 15-20 Warning Points
• Posting a thread 100% denouncing hatred toward marginalised cohorts

Idk why everyone uses this remark to attempt to justify disgusting behavior. You can use the religious argument all you want to justify bigot-related views, However, people cherry-pick religion when it suits them and throws out everything else. Its time and time again blows me away that a religion whose entire basis of existence is "Someone loving you so much" is so intolerant and hateful of people. This is a marketplace, not a church religion should have no place, Nobody has the right to sit here and harass, troll and disrespect people period. There is no "if they are this" "if they love this" "if they do this" hate is hate in any shape and it needs to stop and not be defended. Everyone has the RIGHT to be treated respectfully on here no matter what mistakes happen people say stuff they don't mean to apologize and move on. We're all human just because it's the internet doesn't mean we need to treat people like shit.

All I'm saying is mc-market shouldn't be censoring content un-justifiably. "Homophobic" means you don't support the LGBT community, and people should be able to express "Homophobic" views without censorship, similar to how members of the LGBT community are able to express their views on sexual orientation. Everyone has the right to be treated with respect (What rule 1.6 currently protects), but respectfully expressing your views shouldn't be censored.

Racism is different to "Homophobia" because a person's race is something they are born as and cannot change. Something like being gay is not something that you are born as, its something you choose to be. People shouldn't be forced to support you changing your sexual orientation, especially if its against their religious beliefs.

In my opinion, its just as bad to oppress people with views against homosexuality as it is to oppress people with views supporting homosexuality. How would you like it if respectful expressions supporting homosexuality were censored?

We can agree however that nobody deserves to be harassed, trolled, or disrespected.

People shouldn't be forced to support you changing your sexual orientation, especially if its against their religious beliefs.

I am trying to have a respectful, courteous conversation regarding the OP's suggestion, and you make unsolicited comments bashing on a religion.

My post didn't specifically point out the bible or Christianity, I just stated, people have the right to believe in their own religion and express their views.

MC-market should be censoring hate speech no matter what it is or who it's towards. This is a marketplace the same logic as a workplace should apply. Homophobic's actual definition "having or showing a dislike of or prejudice against gay people." I think it's quite unreasonable to suggest that you should be able to hate a group without censorship. You have commented twice now on "respectfully expressing your views" Could you perhaps give a few examples I'd like to understand where you're coming from on this and what type of remarks you would consider respectful. As I think you would find the other side doesn't view them that way.

I think the debate on homosexuality as a choice is a dated viewpoint that holds no merit. We see it in plenty of animals without the mental capacity for "choosing". Also, why would anyone choose to put up with more bullshit in this very messed-up world? Why would anyone choose to be hated, choose to lose family, friends etc. I also like to dive into the "if it's against their religious beliefs" By your comments here religion would be a "choice". Do you see what I'm getting at here? You cant have it both ways. I've yet to hear one reasonable point to condemn consensual love that isn't based on religion which once again by your own stance is a choice.

I don't see it as oppressing somebody by not allowing them to be hateful to others. I understand the point you're trying to make however it's not that black and white. And I once again would go back to the racism example of this (as it seems to be the easiest for everyone to understand and be on the same page on)

At the end of the day, this is a marketplace, I personally could care less what anyone believes. But speaking in hate against anything should have zero-tolerance. This should be an enjoyable environment for everyone. You do not need to "support" somebody to remain respectful and engage in a business relationship.
