If somebody donates for a non-cosmetic item, and everybody who's currently online receives a different item. Does that comply with EULA?

As long as your server is not competitive and the items you sell don't negatively affect others it will comply with the EULA.
I would post a section from the EULA but the mcm's spam filter is not letting me add it.

Any examples?
I could see a simple SMP being competitive so hence the curiosity

I would say a "competitive" gamemode is like Factions and competing for the FTOP payouts. I know recently that Mojang has squeezed the fun out of Factions by removing payouts if you want to sell store items. Some servers have removed payouts all together whereas some other servers removed rank perks to make it EULA compliant. On the server I used to Administrate we removed payouts and kept rank perks.

This is from their EULA. Leaderboards and payouts are a few things deemed to make a server competitive by Mojang.
  • Be aware that certain games or game modes can be designed as non-competitive (such as a player-versus-environment (PvE) game) and become competitive by adding gameplay elements such as a leaderboard.

This would be eula compliant. You can also make it so everyone had the ability to get the non cosmetic item (such as voting for keys that lead to a small chance of a rank) and to my knowledge that would be eula compliant.
