Just put all of the items on the store considered "unfair" in their own box that players can redeem in the wilderness (or where pvp is enabled), make it extremely hard for other players to get donation items from another user and make it extremely easy for the donors themselves to receive their items. That way, there's technically a chance for anyone to get those "unfair items". Just make sure you mention that "system/method of obtaining donor stuff" in your store (of course you'd keep out the "extremely hard" and "extremely easy" part). I've seen this method being used by many servers in order to circumvent the EULA and it worked.

I mean, obviously you can do the first. Tons of GIANT servers do it; practically every factions server, big or small. If you couldn't do it, those servers wouldn't be here.
No you can't...

Tons of massive servers aren't currently following the EULA and using an SRV rotator to circumvent the blacklist. https://github.com/Yive/RotateSRV

Trust me, I was all there when all of this unfolded with the blacklisting of huge servers and the massive Spigot threads with emails from Mojang clarifying what was allowed and what was not.

I was in the server hosting game between 2014 and 2018 and kept up-to-date with all of this and even converted to an EULA compliant store until everything died down.

Yes this is definitely a way you can abide by the EULA but still give "unfair" advantages. Many servers had done this in the past before you could circumvent the blacklist.

It worked by a player buying a "flare" or similar item from the store and they would have to place it within the warzone. When placed, a crate would drop within a specified radius and the co-ordinates of that drop would be broadcasted in chat for everyone to see. Whoever right-clicked the crate first would get the item, whatever it may be.

The reason why this is allowed is because it broadcasts the co-ords in chat and gives all players a chance to obtain this reward but the most likely person to get there first would obviously be the player who had placed the flare meaning there was a slim chance it would be taken.

The only issue I ever saw with this however was that if that player had paid for that item and was unable to claim it, they may get salty and chargeback or something similar but it has worked in the past but this was really only an option for servers that want pay to win but couldn't have it rather than you not wanting a pay to win experience on your server.
