Ok so you guys know how Wolfram (ETC) have the blacklist netty that blacklists all servers in there gone. Like it isnt there.

I was wondering if it was legal to recreate that (Just not in a hacking way) by using like a ,jar file from minecraft of optifine.

Also if I did would there be any DMCA/Copy Right if I did it from Optifine (I would much rather use optifine than the normal MC .jar)

I may or may not create a server with this method.

Also I am not asking if the EULA (Breaking it) is illegal I am asking if making a custom jar file without it would be copyright etc

Think of the EULA as walking into MC-Donalds without pants or a shirt. They can't arrest you but they can kick you out.

Ok so all I care about is going to jail over a block game XD. They cant arrest me so if I bypass it and sneak in can they arrest?

Already done. It's a simple matter of telling the launcher to download netty from another source. Nothing wrong about client modifications.
