Why are so many servers NON-EULA compliant? Should they not be taken down?

This might come off as being an overstatement but I’ve always felt like the EULA was a form of communism. Mojang wants every player to be on an equal playing field when it comes to multiplayer so they blacklist servers that refuse to change their donator ranks to cosmetic only. They then changed the combat system to where anyone with half a brain cell can PvP. Then to top it all off they start locking Minecraft accounts almost out of pure spite just because they don’t like seeing other people make money off their game, money they’ll never have.
