5.3 says this: "5.3 Do not offer to buy/sell an item or service you do not intend to provide/pay for."

This rule to me, as a resource seller, is very concerning. This basically forces me to give banned members (who could be leakers) licenses.

Let's say I'm selling my resource to WifiSpy and he gets banned for ban evading, I then have to give him a license which can allow him to possibly crack/leak my product.

My suggestion is to edit this rule to protect sellers from people that want to leak/crack while they're banned.

Thanks.

If you post a resource, you are intending to provide that resource which you are offering. If someone you were selling to gets banned and you change your mind about wanting to sell to them, that doesn’t change the fact that providing the product was your true intention when you offered it.

To put it another way: You’re allowed to change your mind when a change in circumstances warrants that change. It is only when circumstances remain the same but your mind suddenly flips that your original intent is called into question.
The rule is only there to prevent users from offering content which they have no intention of actually providing.

If WifiSpy actually purchased your resource in your provided case, you would owe him just 1 download or a refund for it. That is all.

Another thing is pulling back your bid before the seller notes it.

But what about a license key/support?

If a license key is required for the product to work, then the license key is part of the product. You cannot offer them a product that you know won’t function, and call them compensated. If you don’t want to give them a key, then refund them instead.

Support is only required as it is offered and agreed upon by the terms of the transaction.
If your purchase guarantees support for X days, unconditionally. Then you must provide your buyers that support for X days, unconditionally, or refund them.
If you want to add conditions, such as "Unless you get banned", then simply add that condition to the terms they must agree to prior to purchase. You are the one in control of what you’re agreeing to.

Does that "Unless you get banned" condition count for giving out license keys?

Not entirely sure what the answer to this question is, but please create a ticket if this is something you're still curious about and Justis will answer that for you since he seems to be the guru on these sorts of things.

I'll move this to denied since Justis has explained why the initial interpretation of the rule is incorrect. Thank you
