Currently, the rule 5.4 is the following:
5.4 Do not offer or sell anything you do not own or have the right to redistribute.
5.4.1 Do not offer to sell any product or services belonging to a banned or suspended member on MC-Market.
5.4.2 Do not offer to sell any cracked/stolen content, or content containing personal information.

I propose the following to clarify on recent rule changes:
5.4 Do not offer or sell anything you do not own or have the right to redistribute. This includes virtual items (e.g Hypixel Skyblock coins).
5.4.1 Do not offer to sell any product or services belonging to a banned or suspended member on MC-Market.
5.4.2 Do not offer to sell any cracked/stolen content, or content containing personal information.
5.4.3 Do not offer any OEM software unless the original hardware is provided in the deal.

The rules recently changed around Hypixel Skyblock Coins, but there is no physical rule about it. New members aren't going to look through the announcements and see that Hypixel Skyblock Coins are no longer allowed. If we implemented the rule, it will add a (slightly) higher chance for genuine people to see it's not allowed.

OEM software is something I feel strongly about as a key seller. OEM (Original Equipment Manufacturer) software is provided to large companies such as Dell, HP etc to activate their OS's, pre-installed software etc. Legally, you can't sell OEM software unless the original hardware is sold with the software as well. OEM software is often stolen, so it would be a good addition to the rules.

Any opinions below would be appreciated and I'll respond to any questions you may have below.

I agree, your not allowed to sell Hypixel coins as of the announcement - but not having a physical rule is kinda unfair to people who sell them and don't know.

Our rules do cover the Skyblock coins ban:

Hypixel’s TOS forbids its players from reselling in game coins/items, therefore their players do not have the right to resell them.

The issue is not a lack of a rule, the issue is that this existing rule hasn’t been consistently and properly enforced. There’s been too much leniency to the point where it has lost its literal meaning and the line that it was intended to draw is no longer understood.
The crack that shattered that line was undoubtedly the MC account section, which flies in the face of the rule’s meaning.

In my opinion, either we acknowledge all TOS or no TOS.
Why follow Hypixel ToS yet blatantly violate the ToS of Minecraft.

Indeed. Our rules already cover the particular instances you have brought up. We also won't be changing our Minecraft account sales policy at this time.
