So I was studying the Eula as well as the specifications of what you can and can't do and noticed a major loophole to still sell Pay2Win.

They say that you can purchase any "in-game" content with a soft currency, but then they also say "you cannot sell in-game currency for hard currency." noting that they specifically mention ingame so would a loophole not be to sell a soft currency on a website which doesn't translate to a soft currency ingame but is just a singular currency only on the website, bypassing the eula as it has nothing to do with the server itself directly and is a separate instance of the server, then allowing users to pay for Pay2Win content on their server using a technically classed "soft currency" which is not affected by the Eula as it is not at any point in contact, communication or connected to the server.

This has been around for a long time. The fact of the matter is that they can take action regardless of loophole and that the only thing you can do about it is sue them

But still it's a viable option, the only way they could take legal action and succeed is to update the Eula to stop soft currencies from purchasing ingame content and then take legal action against the server.

They don't take legal action, they just blacklist the server and be done with it. The server isn't going to sue them.

But if they blacklist a server using a loophole that legally does not violate the Eula they're doing it illegally.

Honestly, MC was strict on EULA for about a week and it's back to crap. Huge server thats making thousands aren't bothered by the EULA.

They're violating the EULA then, which is breach of contract. In order for anything to happen to Mojang for violating the EULA, someone needs to sue them. Nobody is doing that, and the people who say they will have been saying that for three and a half years at this point; nobody is going to sue Mojang.
