Hey, just have a question, not even sure if this is the right forum but it's related to development soo...
Anyways, when a client purchases a product, such as a plugin, discord bot, website, etc that's "exclusive", what do you guys think that means exactly? Obviously, the developer would be unable to distribute exact copies of that product, but would they be allowed to create products similar to it, possibly with the same idea behind it?
Just basically looking for opinions of what people think exclusive really is.

Depending on their TOS they may be able to resell it. They can always use the same idea, and even the same code sometimes, unless they sign an NDA.

To define exclusive, let's go back to the definition. "restricted to the person, group, or area concerned." (Oxford Dictionaries). For something to be considered exclusive that thing would need to be restricted to only the relevant stakeholders, to the exclusion of all others. If the product being sold was exclusive to one particular entity, let's say, for example, I created a plugin for a service team, and they asked for source code and resell rights. That entity would be entitled to make changes to the original piece of work as they wish. Any changes made to that plugin would still be considered exclusive, as they remain restricted to the person, group or area concerned.

Which is all fine and dandy, until you, however, take into consideration reselling, the act of reselling something can be defined as "sell (something one has bought) to someone else." (Oxford Dictionaries). On that basis, it can be suggested that once the product has been removed from the original owning entity, it would be considered as no longer exclusive. Therefore, if you were to then add to the original product, it would still be considered as exclusive, so long as it does not leave the original owning entity.

If you for argument's sake had just completed a plugin for a client, and you had decided to release a plugin on similar grounds using the parts of the code from their plugin. Creating the same or similar product to one's previous work, using either the same or similar concepts and code would be considered as removing the product from the person, group or area concerned. If you take into consideration what exclusive really means, copying one's own work to recreate or modify a pre-existing product would be considered as self-plagiarism, and would no longer be considered as exclusive as it has been removed from the relevant stakeholders. Personally, I feel that it should be up to the seller to be bona fide about their work and identify that "Hey! Look you know what I did copy almost 3/4 of this other plugin I made, so it's not exclusive." and list it a non-exclusive product.

But that's just my opinion. Everyone is each to their own when it comes to topics like this I suppose.

I agree that the creator should only sell 1 exact copy of the product. However, if they have a new idea which is an expansion on the initial product to the point where it is noticeably different then I think its fine to resell.
