There's a difference between copying detailing techniques and structure and straight up worlddownloading a file. the first is despicable, the second would be illegal if any court took minecraft markets seriously.

I agree, bit you don't see Hypixel complaining and ranting about how Mineplex copies them over every little detail.
Mineplex and hypixel only copy each other gamemodewise, their maps are almost completely different. I know members of both buildteams (though I'm more familiar with the Hypixel ones), and they are both legit and never copy each other. its the gamemodes that get copied, because the owners want to keep up with each other. To avoid potential flamewars I won't express opinions on who copies who, but the two big servers will synchronize in minigames usually inside of a month. It's a business strategy I guess, though not exactly a honorable one. Then again business stopped being about honor ages ago.
Back on topic, there's no real way to stop another server stealing your spawn. an anti-worlddownloader plugin in the way it is available right now will stop roughly half of them, since there are 2 worlddownloader versions and the anti plugin blocks 1.
The best thing to do is to make a PMC post and otherwise announce the presence of your spawn to the public. That way you can at least easily denounce the other server for having stolen your spawn, and that will make it more difficult for them to post their own server with pictures of the spawn there.
