I have a whmcs account with fallout-hosting.com that has a $60 balance and I want to sell it.

Why do I have it?
I requested a refund from a dedicated server, as they took 2 weeks to reply to my thread which asked them to set it up (they never set up my dedicated server and they only replied once)

Instead of giving me a refund they gave me $60 store cash which is very scummy. I refunded on paypal but they won the case.

Yes, they scammed me out of $60 by not setting up the dedicated server. It took them 2 weeks even to reply saying that we could only get a refund in store credit, I lost the paypal case so, whatever, I dont suggest going to the company but hopefully someone will at least buy this account.

I mean... Dedicated servers are non-refundable for many reasons... o.o Costs from the DC makes things un-refundable. They prob racked the server and cant get that money back from the DC or something like that...

If they didn’t provide him the dedicated server in a timely manner then perhaps they should refund him.

Gotta be more to the story than that they refused to refund after not providing the service. I’ve been refunded a few times from a custom server not working out. Also, they’re a pretty honest company that likes to help people out. If you didn’t deserve a refund and they credited you anyways that’s pretty nice of them. I’ve spent quite a bit of money at Fallout and infact have a full rack colocated with them. While at times support can be a tad slow they still provide a great service.

Edit: In regards to what Klanx said about not refunding due to datacenter costs, Ian has paid the dc numerous times for stuff to be done for me and then refunded my purchase after the fact for an issue coming up. If something happens on their end, 9 times out of 10 they’ll gladly go out of their way for you.

While the server was slightly delayed, it was being installed.
Once a system administrator begins work on a system, we generally don't issue refunds.
This is due to system administrators paid hourly to perform these tasks.
Client agreed to account credit + 25% off first month on any new order and 10% recurring.

I charged back because I gave them $60 and literally waited weeks before being told I couldnt get a refund and learned that the machine wouldnt be set up. Is charging back not fair here? They literally scammed me...

They responded within an hour of you creating a ticket and added account credit right away.

In their TOS is states on the very first page "As dedicated servers require explicit provisioning, we are not able to provide refunds on these orders." This applies to almost all server hosting companies and is almost universal for these type of orders.

Also in their TOS:

"If a client charges back, all services will be terminated without refund."

Even though you placed that first chargeback, they kept the account open.

And then:

Additionally, we reserve all rights to terminate your server or service upon any violation of these terms, or any other basis if deemed necessary for the security or “well- being” of our servers and or services Agreeing to the Terms Of Services additionally means you have read, understand and agree to the Privacy Policy located at http://Fallout-Hosting.com/privacypolicy

You agreed to the terms of service. You broke the terms of service TWICE. They have every right to terminate the account.

The reason that most companies terminate after a chargeback is that it usually results in their payment processing accounts to be in bad standing which may result in accounts being frozen. You placed a charge back twice which affected that. Simple as that.

They responded to A TICKET within an hour. I created about 8 tickets with them regarding this issue. I lost $60 and literally didn’t get anything in return. I wanted a refund, NOT store credit. I wouldn’t need the refund if they had just provided the services they were selling. Should I really have to wait weeks before getting a dedicated server? The answer is no, I went to Zerolag hosting who set me a dedicated server up in less than a day and actually responded to my tickets.

How can you defend fallout when they took my $60 and I am left with nothing from them? I just want some money back and now they’re taking the account credit because of this thread.

I’d like to clarify there was a clear reason for me charging back - they scammed me by not giving me my dedicated server and only gave me store credit which by the way is WORTHLESS TO ME. This is SCAMMING. That is why I charged it back. I didn’t charge back to break their tos and spite them, I did it after weeks of trying to reason with them after losing $60 and getting dog shit in return.

Am I insane for thinking I deserve a refund? I literally lost $60 and got NOTHING in return for that money, just a wasted $60.

Issue #1. Flooding with tickets never helps. If they never delivered then you could have easily won the PayPal dispute by providing evidence that you tried to contact them and receive a timeframe in which it was set up. Dedicated Servers are always the worst to deal with when it comes to disputes. (I know from having dealt with a $400 chargeback)

I do not know all the details but from the information provided it seems they have every right to terminate. You lost the dispute because you claimed it was an unauthorized transactionItem Not as Described. That's your issue. From these posts its obvious that you authorized the payment, yet the paypal claim is that you never agreed to pay the amount. Issue closed.It seems you lost the dispute for not categorizing it correctly. After a dispute, companies will never deal with the same client.


EDIT: I see now it says "Item not as Described", the claim should have been filed that it was never received.

To clarify on your most recent reply, it's not our fault you ordered a dedicated server and during its provisioning you wanted to cancel. To make it clear, we typically have a 48 hour or less provisioning time, though there is nowhere listed on our site which states that is the firm time. While a tech was installing your machine, you asked to cancel it because you had buyers remorse (proof). What YOU fail to mention in this entire thread is the fact that you CANCELED your dedicated server order within 48 hours of placing it.
Note: You also paid for a Multicraft installation which takes additional time during the install as our techs need to manually do this as well.

  • I have shown that you have made slanderous remarks to my brand Fallout-Hosting.

  • Dealt with Paypal to reclaim money from a charge-back on the dedicated server and shared hosting.
  • Allowed your account to stay open after the first charge-back as you did have credit on your account.
I feel that I have provided everything that was needed to be said in this thread.

Wow, you write all of that to justify taking $60. I don’t understand what you don’t understand about this: we had $60, now we don’t because you couldn’t give us a refund on a service that you didn’t deliver, how about this: you guys set me up the damn server and give it to me for the month I payed for and I’m done complaining.

It's not a horrible company if you agreed to the TOS and then you request a refund. You're just saying its horrible because you didn't get your refund like you wanted. They also didn't scam you if you agreed to the TOS as it states no refunds will be given to dedicated servers.
