It's free, and no, (before you deleted that other post), you can't sell the spawn, even though I get 50% of it. Sure, you can sell the files, but the spawn is free, and will always be free. You're getting most of the money in this setup from the builds.
Couldn't he technically include it in the package, but just not charge an extra fee per say for it? If it's a free spawn what's wrong with including it, that's just saving the person the hassle of re-downloading and installing it.
If a user is selling the spawn then it's not allowed. If it's "free" in the package, then yes technically that's allowed.
These posts contradict each other. First you said that the seller can't include the spawn in the package and your second post now says he can. You might want to clarify this or simply not allow it to be included at all, as there no real way to tell if he's "selling" it or providing it for free.
Regardless, it probably shouldn't be allowed on the basis of copyright. OptiBrine owns exclusive distribution rights to the build and therefore, the seller isn't legally allowed to distribute the build (whether or not it's free) without OptiBrine's permission, which he doesn't appear to have.

I stated that the seller may sell the spawn, only if it's "free". Looking at this, I would appraise the configurations itself to be worth around $2. The spawn itself is the main cost of the whole setup. He doesn't have my permission to sell it, if they're charging money from it, which clearly they are, unless they lowers the BIN price. Even if they do, TO make this clear, No, the seller is not allowed to include the build with the setup.
You appraisal is irrelevant here. You can either allow him to distribute the build or not. He can charge what he wants for the configuration and include the build regardless if you give him permission to.
