The Sale of Steam Games

Long story short, after a brief talk with an onsite member he helped inform me that an activity that I was attempting to participate in was against the TOS of both MCM & Steam. I obviously knew this was against the TOS of Steam, but not of MCM. Is the resale of steam games a bannable offense/against TOS? I have seen MANY users onsite doing this, and according to the person I was having a conversation with they stated it was in fact against a specific rule, rule 5.4. This rule states, "Do not offer or sell anything you do not own or have the right to redistribute". I now understand that this is against the TOS, but why has this rule been so lightly enforced?

Also, not to bash anyone trying to hustle, but why is selling discord nitro allowed on here? The majority of their methods exploit a similar exploit or are simply carded.
