But you can be banned simply for having too many warning points, not always scamming.

Maybe a middle ground would only be to unsticky/pin a thread owned by the banned user if the thread is what he was banned for. i,e user had a thread offering his services as a builder. if he scammed for a build, then his pinned builder thread gets removed.

If a user is banned and they still have a thread stickied please create a support request and it'll be dealt with. I don't see why we would need to add something to our TOS. If a user was banned for scamming I have no problems with disabling their sticky.
