Shouldn't they give it back to Hey_david?

Currently can't access namemc, but from what I remember is that there's the account "Hey" which has no name history and also "HerrNilsson" who changed the name 10 minutes before namechanges came out.

"Hey" with no history is the real owner and a Mojang Employee who owns HerrNilsson changed their name to "Hey" as a test 10 minutes before name changes without realizing "Hey" with no name history existed. So now they changed their name back.

Is the original "Hey" not there? It has a jesus skin I remember.

The first name change to occur when name changing was open to the public was this account: https://namemc.com/s?Batman. "HerrNilsson" was changed to "Hey" 11 minutes prior to that. "HerrNilsson" also sounds like it might be Swedish. Therefore, I would assume "HerrNilsson" was changed to "Hey" by Mojang. Perhaps Mojang gave employees one last chance to grab a name they wanted before name changing was open to the public and all the names would be taken.

Or perhaps they were testing the system. I can imagine myself as a dev, before releasing a huge thing, to test it minutes before just to make sure it works.
Yes, possibly. Either way, the point is that Mojang did not just steal the name "Hey" from someone else.

Another thread full of people who supposedly deal with accounts all the time, but have no idea how they work. If you look at my account YOLO, you can see I also did a name change before the feature was public. Heck, my Marc account was changed months before. The reason some names got taken was because there were names that were registered years before, but no one ever bought the account. Those accounts were all eventually deleted, and freed up for people to select. Obviously (or maybe not so obviously), no employee is going to take someone's paid account. At this time, our options are the same as yours: pick a name that doesn't yet exist, or wait until after someone changes away from a name.

I love how all the account traders like to get pissy over every single OG account that they can't sell. As soon as an OG account isn't available to get by any means, its all "mojang sucks" and "mojang's corrupt" and whatnot.
No people, it doesn't work that way. You don't have the right to an OG account, not unless you originally namechanged into it.
Maybe it's a little "unfair", but seriously life isn't fair. before the captcha idea, I could also complain that its not fair that a bunch of people with scripts written specifically for it were getting all OG and semi-OG names. Does that mean that snipers were corrupt? nope, it means the world is a harsh place and you best deal with it.

Wat

This thread was made because people had misconceptions of what happened to a username. Of course it turned out the mojang employee already owned the name and he never took it from anyone.

So what about 'Steve'? Before, there were multiple who had that name, but had switched their name... Now there is one.. and coincidentally enough it has a Minecon 2011 cape... huh... odd.
