Will requesting paypal refund get me banned?

Hi, I belive I am being scammed, I hired somebody to create a setup almost 2 months ago, I still keep in contact with him but I have no proof of work being finished and he has had claims against him in the past. If I ask paypal for the refund is he able to report me? Should I create a scam report first??
