Unfortunately the logo does not have resale rights. I remember this project and went digging around my old Discord chat logs to see if anything was discussed, but I saw nothing regarding the resale rights being granted.

You really need to change your TOS, if I was a customer looking to buy art that would honestly drive me away from your company.

You really need to change your TOS, if I was a customer looking to buy art that would honestly drive me away from your company.

This clause applies for pretty much half the market, and is a standard for any well established freelancer. Designers and developers (and other professions) work very hard on their products and from their perspective, if their hard work is just being resold in an endless cycle and other users are making money off of it, they do feel a bit annoyed.

Imagine you are a developer who developed a plugin for one specific person, then you realise that that person has been reselling your work multiple times and has actually made a profit off of that. I doubt the original developer would be happy in this case.

For this specific case regarding artwork - All the well established illustrators on the market do this. When I mean well established, I mean those who perhaps pursue art in real life or have been on the market long enough to know that terms of service exist.

Here are some examples I picked up :

These are typically the top artists who has done hundreds of commissions (with exceptions) and their work is in high circulation in the market. It is your responsibility as a client to read the terms of service of any freelancer you hire.

A final note. We do grant resell rights to those who have been "given explicit consent". We have given out rights to past clients because they did discuss with us and we came to a certain agreement and price.

I honestly think that as long as the seller isnt making a profit from the art alone and actually adding other assets such as in this case the discord server it shouldn't matter. It's a bit stupid that art especially for servers cannot be resold when most servers are eventually sold anyway. As a buyer that would turn me away from your company, but that's your terms of service so I respect that.

As for the resale of this, are you putting this on hold or is this carrying on?

The fact that the value of this sale is increased due to the logo does mean that the seller is making some sort of gain from reselling it. Like I said earlier, almost all top illustrators have similar terms of service when it comes to artwork. We aren’t an exception. I only enforce and mediate my artists wishes in the end.

Additionally, you just have to discuss the resale rights with us beforehand. We aren’t outright barring this logo from being resold in the future.

The seller has not contacted me regarding the resale rights of the logo yet, hence permission has not been given. If he still wants it, he is more than welcome to contact me so we can discuss it out with our artist.

Yeh I wouldn't buy art for my domain if I couldnt resell it. That drives me from your company as well. You want someone to pay for a new logo on the same domain?

I can't stress the fact that all the client has to do is contact us and come to an agreement with our artist. I repeatedly stated in all my above messages that we do give out resell rights to clients who actually discuss this with us. No one has contacted us regarding that, so clearly he does not want to include the logo anymore.
