Abolishing the 13 years of age rule

Hello, MC-Market.

I am making a suggestion due to one of my fellow Slashy_Hosting members being banned and I am annoyed at it to be honest, I am fed up with discrimination from appearance.

A recent example being PurpleStorms he was banned for "being underage" when I speak to one of the staff members the reason has reveled that they had not solid proof...
The proof behind the ban was `his appearance`

You may not trust me on this issue but I do have proof backing my end of support on this situation and I shall be providing it now, http://prntscr.com/fr7mxd

I don't want it completely abolished just make it so staff are aware that you need solid proof or a confession

I will not be naming the staff member who banned him as you can find that yourself but I would not like to start a war with staff on this issue.

Another point that should be included not in favor of the suggestion, do you really think people under the age of 13, even 15 is questionable, should be given the ability to deal money online? Especially in an environment solely based on trust and past reputation.

this is basically what i came in the thread to say. i thought up until seeing this thread that the age limit was 16 and was comfortable with that. and while i think staff should have solid proof of someone admitting or similar, i don't see why anyone would have any public information/pictures of themselves anyway.[DOUBLEPOST=1499120586][/DOUBLEPOST]*to add on to the part about age limit itself i wouldn't be extremely comfortable dealing with a user if i knew they were younger than 16.

The age limit being increased/decreased/abolished is not the point of the thread. It is to "improve" the system in which a staff bans a user because they are below the age limit. root wants to make it so that the staff need to have evidence that they are under 13 years or under.

PurpleStorms was like 11. He begged me to join his build team, and when I joined a discord call with him, he sounded like he was 9. His voice was so high pitched. You can obviously tell he is not 13+. There's your "solid proof".

At the end of the day, it's whatever the owners of the site want. It's their site you're on and they get to set the rules. While I do believe maturity isn't exactly defined by your age (I know many 15 year olds who are maturer than most of the 20 year olds I know) it's not exactly our call to make as a user of their service. Just something to think about.

Okay, the problem with the looking and sounding claim is that you can just be a late bloomer. I was a squeaker till i was 14. Also with the admitting part, people joke around. I don't see how this rule is enforceable at all. I'd like to add that I was 11 when I first learned to do art, I loved having places to sell it as encouragement. All mc-market is doing is limiting the next generation of people who offer services. This should be abolished, I know many people under 12 who offer services that are better than many people here over 13.

Someone could have a disease which makes them look younger or whatever. If there was no proof but just his appearance then IMO that is just plain wrong.

This forum is essentially a social networking site and records the data of users. In the US it is illegal to get this information from anyone under 13. However I do agree that they should have better judgement then just how they look.

Wow so much talking inside a day. The point has already been made. it's a legal question. Under 13 years of age the site is not allowed to collect identifiable data about a user without the express consent of their parents. Identifiable data being emails, Ip's, etc. Rather than creating the extreme bother of asking for explicit consent from their parents in the shape of a signed note or something similar, MCM has chosen to forbid people under 13 from joining. It is the one ban that is fully appealable now, you just need to be 13.

I still don't see the point of this thread anymore. It was made clear that the rule exists in order to comply with the law. There is no way for us to change the law. That being said, this rule can't be changed. If it can't be changed, why argue for it to be changed?

I don't understand why you would ask Lyphiard about the ban if I placed it. If a user is falsely banned, they create a temporary account for their appeal. There is no such thing as "appealing for others".

This is not something we are doing to be mean. By law, MCM is required to get parental consent for all users under the age of 13 before storing personal information about them.

Through the link he posted, it made clear that he was under the age of 13 to the average, reasonable person. This isn't about edge cases or anything like that, because law almost always leans towards the view of an average, reasonable individual. If MCM sees that a user is underage, it is obligated to stop said user from accessing the service since we don't want to deal with the hassles of complying with COPPA.

If PurpleStorms is truly 13 or older, then he can provide proof through a support request and he will be unbanned. However, based on your reactions and your previous messages to me regarding this NDA, I'm going to assume he isn't and that you guys are just creating a commotion because he got banned.

In addition to this, we do hold additional evidence of the user being underage. Which will be disclosed directly with the Member banned if they feel it was incorrect. Clearly, there's a limit of what you think root.

We have the right to enforce our Terms of Service which complies with the law.
