Lets make this simple. I had a forums page that had the disk wiped and I lost all my files. It was made by DarkKnight but I need someone to remake it because I need it done asap. I want it to look almost exactly the same. I need it installed on my dedicated server.

Additionally, I have a slight feeling having someone else create a forums site directly based on Dark's work would upset him quite a bit. It is also borderline copyright infringement.

I am trying to release my server and his responses are extremely slow and vague. I offered to pay him to give me a backup of it and just gives me the slowest replies and hasn't said anything in a while.

I agree it is valid. But almost all these people making forums make them look nearly identical anyways

Agreed. But you've already made it public your intentions and your acknowledgement that it is infringing.
I was simply warning you, he DOES rightfully have this on all his forums, meaning he does have a unique identification between his coding and other's, if he didn't he never would have received a Copyright License. In order to make a site look like his, whoever is coding would have to be copying the element code from his sites.
