Its kind of a grey area. Tbh i wouldnt worry, mojang arnt going to spend time trying to work out if this does breach the EULA or not, with all the factions servers that break it in so many ways.Depends, they can just glide between platforms they create on there island, they can not perm fly all the time, they will land then have to take off again.
It is if it is for all players. Not just for people buying the perk.

It's still a perk. Players who didn't donate can't fly, donators can.What if players can fly in a hub, with a perk. Gives no advantage, and its EULA compliant. Its not a simple yes / no. It depends on the server.

Trails are cosmetic, fly gives you advantage to climb somewhere.So, by that logic trails dont comply, players cant have them, donators can. Same logic, the trails dont give an advantage, nor does fly on some servers, like a hub. Do a little research before making comments like that.
If you are in a hub, explain to me how fly would give you an advantage, there is no game in play. Its just going to the game you want. There is no advantage to gain. I could sell a sharp 500 sword, but if its in a hub, there is no pvp so it gives no advantage, just like the fly.
