As a small server you are fine, there are many obvious loop holes in the EULA and by the time you're big enough you can hire a legal team (I needed) to help you out.

All emails sent to Mojang about Eula are usually ignored. You cannot sell items to a player that can change his/her game mode experience. All players must stand on the same level as every other player.

Yeah, ultimate, you will get thrown in jail by a Minecraft EULA and you will have to remove all your ranks and your server will get shutdown because you didn't listen to the EULA.

Every server owner needs a better explained EULA the current one is barely detailed. You don't need a damn updated EULA. Your probably not even old enough to be sued. Your server WILL not get popular enough for Mojang to actually give the slightest care. The EULA is a document made in a block game to scare you from getting people to buy your donation packages. If you haven't noticed, it's been over a year and no one has been sued or even acknowledged for getting in trouble over the EULA. Please make your alternative mineplex, it won't last long enough for you to get in trouble over the EULA.

Honestly I think nobody follows the EULA server rules nowadays. I've seen a lot of servers still using the previous donation perks / buying credit. Unless you are a big server you have nothing to worry about
