    License terms
    Use in your projects

    For simplicity, we have two options as far as what projects may utilize a purchased product:
    • Only one project - A license restricted to one project may not be used by multiple projects at a time. If ownership or control of the associated project is transferred to another individual, that project must no longer utilize the product unless the new owner or controller acquires their own license and copy of the product, at which point you may choose to utilize your copy of the product on a different project instead. If a project you’ve used the product on is shut down, you may similarly choose to utilize the product on another project instead, so long as the product is not used by multiple projects at once.

    • Unlimited projects - A license that may be utilized by any project owned and controlled by the license holder. If ownership or control of an associated project is transferred to another individual, that project must no longer utilize the product unless the new owner acquires their own license and copy of the product.
    In either instance, the license is being issued to the natural person who makes the purchase, and not the project or company that uses the product. When a product is in use by a project, that product’s file may be accessed by the necessary individuals directly associated with the operation and management of that project in order for the product to function as it was advertised and intended. The license holder retains responsibility for limiting access to their copy only to those that require access. If an individual who the license holder has granted product access to were to redistribute or otherwise violate the licensing terms for the product, the license holder would be held entirely responsible.


    Attribution
    If the product contains attribution, such as a watermark, a footer, a logo, or other types of credit or creator branding, this must not be removed or modified unless “Remove attribution” permissions have been granted to the license holder.


    Hosting
    Copies of the product may be made and transmitted to hosting services for the purpose of utilizing the product as it was advertised and intended. License holders retain responsibility for ensuring that access to their copy of the product remains secure. If a copy of the product were to be redistributed without authorization, the license holder would be held entirely responsible.


    Commercial use
    Products may be utilized commercially, meaning that the license holder is permitted to earn money as a consequence of utilizing the product as it was advertised and intended. This should never be confused with permission to resell copies or access to the product, which is restricted by the “resell” licensing terms.


    Modification
    Products may be decompiled, viewed and modified as necessary in order to suit the buyer’s individual needs, so long as doing so does not violate Acceptable Use, Attribution, or other applicable terms. Modified versions of the product are subject to all of the same licensing terms as the original product. A work is considered a “modified version of the product” if it contains or was derived from the original product, either in part or in full, regardless of the quantity of new or non-derivative content that may have also been introduced to the work.


    Resell
    Reselling a product or access to a product is expressly disallowed for all license types. This includes modified versions of the product. Indirect or direct access of any copy, modified or not, in part or in full, must never be resold to anyone. This does not mean that other paid products cannot include this product as a dependency. Redistribution of products as a dependency to another product is governed by our “redistribution” terms.


    Transfer license
    Transferring product licenses, as with reselling, is expressly disallowed. This includes selling a license, giving away a license, including a license in the sale of a business, etc. If ownership of project or business that utilized a licensed product is being transferred or sold, then the licenses to any products in use by that project or business are retained by the original license holder and do not transfer to the new owner of the project or business. The new owner must obtain their own license and copy of the applicable products.


    Sublicense
    When you receive a license, you are receiving a license to utilize that product in your licensed projects. This license is not sub-licensable. Therefore, if your project is one where your end users or customers are owners or operators of their own projects, you may not share or pass on any of the permissions you receive from this license to your end users’ projects or their owners or operators, including the right to use the product in their projects. They will need to individually obtain their own license.

    As an example, a game server host cannot acquire a license to some software which modifies the behavior of a game server and share their permissions to use the software with their customers. Each customer would need to individually obtain their own license to use the software in their game servers, as each individual game server would be a project in need of a license.


    Redistribution
    “Redistribution” refers to the transmission of a copy of a licensed product, modified or unmodified, either in part or in full, to anyone who the product does not need to be accessed by in order for the product to function as it was advertised, described and intended as part of a licensed project.

    Some product types, like graphics or website front end, inherently end up being transmitted to end users as part of the licensed project’s normal functioning. This normal and necessary transmission to end users is not considered “redistribution” as defined by this license and is permissible to the extent that it is necessary for the project to function so long as it does not violate this license’s Acceptable Use or Sublicense policies.

    If redistribution permissions have been granted, then those who receive a copy of the licensed product must agree to the End User License Agreement associated with the product. This agreement will be direct to the end user, not a sublicense by the user who redistributed the content.


    Additional licenses
    Some assets utilized by a licensed product may be obtained from a third party and come with their own licensing terms (MIT, GPL, CC, etc.) In such cases, the third party license will apply to that asset only, or only to the extent that that asset’s license must apply to other elements of the product using it. This license will apply, in full, to all other elements of the product, and will also apply to the third party licensed elements to the extent that this and the third party license’s terms are compatible.

    If the licensed product contains dependencies that were obtained from BuiltByBit and included with redistribution rights by the product creator, the user of this licensed product agrees to the End User License Agreement associated with those dependencies. If the user of this licensed product requires assistance identifying the products that have an associated BuiltByBit EULA, the user agrees to be held responsible for requesting the necessary assistance from the product creator.


    Support
    A buyer is always entitled a fully functioning copy of their purchased product. Any requests for support in receiving a copy of a purchased product or getting the product to function as described within the first thirty days after purchase must be responded to within five days and resolved without undue delay or a refund will be due. If the buyer has received a fully functioning product but has misplaced their copy and it has been longer than 30 days, a creator must provide assistance in acquiring an additional copy if they are readily available and able. Requests for support must be made from a confirmed active communication channel such as a linked discord, BuiltByBit direct messages, a support server linked within the context of the product/service, etc. Requests for features which were not advertised as being included in the version available at the time of purchase do not qualify as support requests. Compatibility updates (e.g, updating a Minecraft plugin to support a newer Minecraft version) are not guaranteed in order for the product to “fully function as described”; a product dependent on other software is only guaranteed to function with the version it was specified to have been compatible with, or the current version at the time of purchase if a compatible version was not specified.

    One aspect of ensuring that buyers receive what they're reasonably expecting is that the product should be in good standing with BuiltByBit's policies at least during the immediate future after purchase. Buyers may therefore request a refund through a transaction dispute if, within 30 days after their purchase, the product is either removed by BuiltByBit's moderation team or removed during the process of a DMCA claim. Creators can resolve such a transaction dispute either by issuing a refund or by bringing the product back into compliance within a reasonable timeframe and re-publishing it. In the case of a DMCA claim, this could either mean re-publishing the product with the allegedly infringing content removed, the alleged infringement resolved, or by issuing a counter-claim. Whether due to rule violations or a DMCA claim, temporary re-publication is not sufficient in order to avoid needing to refund. If the product is again removed for one or more of the original reasons for the product's removal, the buyer is still entitled either a refund or for the issues to be fully and permanently resolved.


    Termination
    This license may be terminated only if a refund is provided or this EULA is violated in a manner which resulted in a ban from BuiltByBit or would have resulted in a ban if one was not already in place. If this license was received for free, then it may be terminated by the issuer (the resource creator) for any reason.

    Acceptable use
    1. Products cannot be used in a way which would violate the policies of BuiltByBit or the laws of any relevant jurisdiction
    2. Products must not be used or distributed in a manner that would violated the most up to date version of this agreement. If you do not wish to agree to the most up to date version, you may cease all use and activities involving the applicable products.
    3. Products must not be modified or installed in such a way to remove or disable a DRM system or tracking data that may be in place to protect the product. Tracking data includes BuiltByBit’s anti-piracy placeholders which are populated on download with identifiers to assist in locating the source of a leak if the file were to be distributed.
    4. You cannot use a licensed product in a project where the end users can customize the product to their specifications. (e.g, a server host cannot provide server owners with access to a product that the server owner is able to customize to their needs for their own projects)
    5. Configurations for products may be freely modified and redistributed unless the product itself is a configuration or a collection of configurations. The configuration provided with the original base product to which the configuration belongs is a template that must be allowed to be modified and shared by future users. However, modified versions of that configuration that have been released either as a resource or addon as standalone or a “setup” including a collection of modified configurations are themselves products and protected as such.
    Frequently Asked Questions
    • Will I lose my license if I’m banned from BuiltByBit?
      No, your BuiltByBit account’s standing does not impact your license unless your ban was a result of having violated this agreement, although a ban will prevent you from being able to access future versions or downloads through our services.
    • Will I receive access to future versions?
      A buyer is entitled a fully functioning copy of the product as it was described at the time of purchase. Access to future versions is provided as a convenience and are never guaranteed.
